Pour ce faire, nous aborderons en premier lieu la description et l’analyse de la loi libyenne sur l’immigration, en la mettant en regard avec les principes fondamentaux des droits de l’homme. Cette étude repose sur le postulat selon lequel la stabilité de la sécurité est nécessaire pour garantir ces droits. Nous expliquerons la relation entre les violations auxquelles les immigrants sont exposés et la situation sécuritaire détériorée en Libye, en analysant la capacité de l’ordre public en Libye à protéger les étrangers en général, via la pleine application des lois d’immigration ou la possibilité de garantir le minimum de leurs droits à travers les lois générales existantes. Comme l’immigration irrégulière est un phénomène international, nous étudierons, dans la deuxième partie, la coopération de la Libye dans ce domaine au niveau international, afin de mesurer l’importance de cette coopération pour les immigrants. Il s’agira d’établir dans quelle mesure l’insécurité et l’instabilité politique en Libye affectent cette coopération ainsi que l’engagement envers les accords auxquels le pays est partie. À cet effet, nous présenterons les diverses modalités de la coopération entre les pays d’origine (qui sont les pays africains) et les pays de destination d’immigrants (à savoir les pays européens), en soulignant le rôle libyen et le degré de mise en œuvre de cette coopération. This work aims to study the situation of immigrants in Libya, identify their most important fundamental rights, and the violations they are exposed to. To achieve this, we will first address the description and analysis of Libyan immigration law, juxtaposing it with the fundamental principles of human rights. This study is based on the premise that stability and security are necessary to guarantee these rights. We will explain the relationship between the violations immigrants are exposed to and the deteriorating security situation in Libya, analysing the capacity of public order in Libya to protect foreigners in general, through the full implementation of immigration laws, or the possibility of ensuring the minimum of their rights through existing general laws. As irregular immigration is an international phenomenon, we will study, in the second part, Libya's cooperation in this area at the international level, in order to assess the importance of this cooperation for immigrants. It will be a matter of establishing to what extent insecurity and political instability in Libya affect this cooperation as well as the commitment to the agreements to which the country is a party. To this end, we will present the various modalities of cooperation between the countries of origin (which are African countries) and the countries of destination for immigrants (namely European countries), highlighting the Libyan role and the degree of implementation of this cooperation.
