Contrats administratifs Contrats -- Interprétation Contentieux administratifs L’interprétation des contrats administratifs par le juge administratif peut être comprise à l’aune d’une théorie rationnelle de l’interprétation juridique. Pareille théorie, en ce qu’elle met en évidence la normativité de l’argumentation juridique, permet en effet de représenter l’interprétation contentieuse des contrats administratifs comme un évènement incertain mais prévisible, c’est à dire comme un risque et non comme un aléa pour ses destinataires. Une fois cette représentation éprouvée, à travers l’exemple de l’interprétation des clauses non négociées des contrats administratifs, il est dès lors possible d’en étudier le traitement. L’incertitude qui affecte la réalisation de ce risque et, partant, ses conséquences, ne saurait en effet laisser le droit indifférent. Cette étude révèle que l’efficacité de ces traitements est profondément différente selon que l’on s’intéresse au rôle des parties ou à celui des juges. Cela ne saurait surprendre car la liberté contractuelle des parties sur laquelle reposent les trois traitements que ces dernières mobilisent (clauses d’interprétation, avenants interprétatifs et arbitrage) a toujours été contrebalancée par la liberté du juge administratif face au principe de la force obligatoire des contrats administratifs. C’est donc à travers le rôle du juge de cassation, plus que par celui du juge saisi d’un recours en interprétation, que l’efficacité du traitement du risque d’interprétation contentieuse peut être assurée. En venant limiter la liberté du juge administratif, il donne les clefs à la technique contractuelle afin d’atteindre cet objectif. The interpretation of administrative contracts by the administrative judge can be understood in the light of a rational theory of legal interpretation. Such a theory, insofar as it highlights the normativity of legal argumentation, makes it possible to represent the contentious interpretation of administrative contracts as an uncertain but foreseeable event, i.e. as a risk and not as a hazard for its recipients. Once this representation has been tested, through the example of the interpretation of non-negotiated clauses in administrative contracts, it is then possible to study the methods used to handle this risk. Indeed, the uncertainty which affects its occurrence and its consequences cannot be ignored by the law. This study reveals that the efficiency of these methods is profoundly different depending on whether one is interested in the role of the parties or that of the judges. This is not surprising since the parties’ contractual freedom, on which are founded the three methods they use (interpretation clauses, interpretative amendments and arbitration), has always been counterbalanced by the administrative judge’s freedom with regard to the principle of the binding nature of administrative contracts. Thus, it is through the judge of cassation's role, rather than that of the judge seized of an interpretation appeal, that the effectiveness of the handling of risk in contentious interpretation can be ensured. By limiting the administrative judge’s freedom, he provides the contractual technique with the means to achieve this purpose.
