Souvent présentés comme des instruments bi-régionaux, cette qualification ne semble pourtant pas opportune au regard des catégories usuelles du droit international public, ordre juridique dont ils relèvent, et paraît minorer leurs singularités à l’aune des schémas empruntés par les relations extérieures de l’Union européenne. Si, en droit de l’Union européenne, le critère du nombre de Parties à un accord ne semble pas constituer un paramètre déterminant dans l’identification du régime applicable à l’instrument étudié, il est considéré en droit international comme le plus pertinent. Ainsi, tant l’identification de la qualité des Parties que celle de leur nombre permettent d’identifier le régime juridique qui encadre l’exécution d’un traité. Le caractère supposé bi-régional de ces instruments se fonde sur la notion de région, terme particulièrement ambigu lorsqu’il est appréhendé par la science juridique. Aussi, c’est à l’analyse du processus d’élaboration de ce cadre conventionnel qu’il est possible de constater l’utilisation pragmatique et stratégique de cette notion, qui sert tant les objectifs de la régionalisation des relations extérieures de l’Union européenne que l’enjeu de pacification régionale centraméricain. Or, le Système d’Intégration centraméricain qui se laisse parfois confondre avec la notion de région centraméricaine n’est Partie à aucun des deux accords. Dès lors, en admettant que le régime d’un traité découle de la qualification qui en est faite, force est de constater que le caractère bi-régional supposé ne permet pas de cerner les spécificités du régime juridique de ce cadre conventionnel. En tenant compte du nombre et de la qualité des Parties, les instruments qui le composent se révèlent être plurilatéraux, mais également mixtes. En tenant compte de leur contenu, ils sont l’illustration parfaite du traité-cadre. Ces différents éléments permettent alors de formuler des propositions afin de qualifier juridiquement le cadre étudié. Toutefois, il apparaît clairement que les véritables marqueurs de la singularité de ce cadre conventionnel sont constitués par la figure de l'ADPC et l’application provisoire de l’Accord d’association qui vient se juxtaposer à l’application intégrale du premier, donnant au cadre conventionnel un caractère des plus aboutis. Cette démarche conceptuelle vient ainsi mettre en évidence l’avènement d’un modèle singulier de relation extérieure de l’Union. The conventional framework of the EU-Central America relationship consists of a Political Dialogue and Cooperation Agreement (PDCA) and an Association Agreement binding the EU and its Member States, on the one hand, and six Central American states, on the other hand. Often described as bi-regional instruments, this qualification does not seem appropriate in the light of the usual categories of public international law, the legal order to which they belong, and seems to diminish their singularities considering the patterns followed by the European Union’s foreign relations. If the criterion of the number of Parties to an agreement does not seem to be, in EU law, a determining parameter in the identification of the legal regime applicable to the instrument under examination, it is considered as the most relevant in international law. Thus, both the identification of the quality of the Parties and the number of Parties make it possible to identify the legal regime that governs the execution of a treaty. The supposedly bi-regional character of these instruments is based on the notion of region, a particularly ambiguous term when apprehended by legal science. The analysis of the process of elaboration of this conventional framework makes it possible to acknowledge the pragmatic and strategic use of this notion, which serves both the objectives of the regionalization of the Union’s external relations and the challenge of Central American regional pacification. However, the Central American Integration System, which can sometimes be confused with the notion of a Central American region, is not a party to either of the two agreements. Therefore, and admitting that the regime of a treaty derives from its qualification, it must be noted that the supposedly bi-regional character does not make it possible to define the specificities of the legal regime of this conventional framework. Considering the number and quality of the Parties, the instruments that compose it turn out to be plurilateral, but also mixed. Considering their content, they are the perfect illustration of a framework treaty. These different features then enable to make proposals in order to legally qualify the studied framework. It appears clearly, however, that the true markers of this conventional framework’s peculiarity are constituted by the figure of the PDCA and the provisional application of the Association Agreement, giving the conventional framework a more complete character. This conceptual approach thus highlights the advent of a singular model of the EU’s external relations.
